国际商事仲裁第三方资助规则中的披露义务研究

Research on Disclosure Obligation in the Third-Party Funding Rules of International Commercial Arbitration

摘要: 文章围绕国际仲裁中的第三方资助规则展开，梳理了其作为新兴投资形式在国际投资争端及商事仲裁领域的应用现状，指出由于第三方资助者不直接参与仲裁程序，导致仲裁员与资助者可能产生一定利益冲突问题。通过分析第三方资助在国际商事仲裁中的特殊性，就仲裁协议有关的数个信息是否属于应当披露内容展开论述，旨在平衡仲裁程序正义与投资者权益保护，为完善相关披露规则提供理论参考。

Abstract: This article focuses on the rules of third-party funding in international arbitration, pointing out the current application status of this emerging investment form in international investment disputes and commercial arbitration. Due to the fact that third-party funders do not directly participate in the arbitration process, there may be certain conflicts of interest between arbitrators and funders. By analyzing the particularity of third-party funding in international commercial arbitration, this article discusses whether several pieces of information related to the arbitration agreement should be disclosed, aiming to balance the justice of the arbitration process and the protection of investors’ rights and interests, and provide theoretical references for improving the relevant disclosure rules.
