醉驾型危险驾驶罪的刑法规制与治理路径研究

Research on the Criminal Legal Regulation and Governance Approaches for the Crime of Dangerous Driving under the Influence of Alcohol

摘要: 刑事立法与刑事司法共同构成刑事治理的两大核心内容，但立法目的终究需要通过司法活动得以实现，因此，刑事司法的现代化进程在很大程度上决定了刑事治理现代化的实现。近年来，醉驾型危险驾驶罪已成为我国刑事追诉数量最多的犯罪，通过对该罪司法适用情况的考察及相关问题与对策的研究，一方面可从微观层面反映刑事司法的现代化程度，另一方面能够推动醉酒型危险驾驶罪的科学认定，规范犯罪附随后果的治理进路，助力刑事犯罪治理现代化。

Abstract: Criminal legislation and criminal justice constitute the two core components of criminal governance. The objectives of legislation are ultimately realized through judicial activities; thus, the modernization of criminal justice largely determines the achievement of modernized criminal governance. In recent years, the crime of dangerous driving under the influence of alcohol has become the most frequently prosecuted offense in China. Examining the judicial application of this crime and studying related issues and countermeasures not only reflects the degree of modernization in criminal justice at the micro level but also facilitates the scientific determination of such offenses, standardizes approaches to addressing their consequences, and contributes to the modernization of criminal governance.
