A Study on the Impact of Divorce Property Division Agreements on Creditors’ Rights and Interests

摘要: 离婚财产分割协议兼具人身与财产双重属性，系夫妻解除婚姻关系时对共同财产、债务及损害赔偿等事项的清算安排。随着社会经济关系变化，该协议对债权人权益的潜在影响日益显著。从协议性质出发，财产清算说更能涵盖协议对积极与消极财产的全面处置特征。在此基础上，协议影响对夫妻共同债务的认定，需要引入信赖利益规则以平衡债权人保护与配偶权益。对不动产的处置条款，权属约定未经变更登记仅具债权效力，在特定条件下可排除强制执行，但债权人具有撤销权，得以维护自身权益。应在尊重婚姻关系双方意志的前提下，通过完善撤销权制度、细化共同债务认定标准并明确排除执行例外情形，有效保障债权人利益与交易安全。

Abstract: The divorce property division agreement possesses both personal and property attributes, serving as a liquidation arrangement for community property, debts, damages, and other matters upon the dissolution of marriage. As socioeconomic relations evolve, the potential impact of such agreements on creditors’ rights has become increasingly significant. From the perspective of the nature of the agreement, the property liquidation theory better encompasses the comprehensive disposition of both active and negative property (i.e., assets and liabilities). On this basis, when the agreement affects the determination of joint spousal debts, the reliance interest rule should be introduced to balance the protection of creditors with the rights of spouses. Regarding real property disposition clauses, the ownership agreement, absent a registration for change of ownership, has only contractual (claims) effect. Under certain conditions, it may preclude compulsory enforcement, but creditors retain the right of revocation to protect their own interests. While respecting the autonomy of the parties to the marriage, the protection of creditors’ interests and transaction security should be effectively ensured by improving the revocation system, refining the standards for determining joint spousal debts, and clearly specifying exceptions for exclusion from enforcement.
