慈善法修订背景下社区慈善发展的法治路径研究

Research on the Legal Path of Community Charity Development in the Context of the Revision of the Charity Law

摘要: 社区慈善作为植根于中国传统文化与基层社会的慈善形态，对于夯实我国本土慈善事业发展基础、推动基层治理提质增效具有独特价值。然而，其发展仍面临法律地位有待明确、组织主体合法性困境、运行机制和激励机制与监管机制不完善等挑战。本文立足于新修《慈善法》，结合国家与社会关系、公共领域相关理论，剖析社区慈善的价值定位与本土特征，梳理现行慈善法对社区慈善的规范与局限，结合广州市、成都市锦江区两个典型案例提出社区慈善发展的系统性法治路径，强调通过科学立法与规范治理，推动社区慈善在法治轨道上行稳致远，使其成为促进社会均衡发展和构建和谐社会的重要力量。

Abstract: As a form of charity rooted in traditional Chinese culture and grassroots society, community charity holds unique value in consolidating the foundation for the development of China’s indigenous charity sector and in promoting the quality and efficiency of grassroots governance. However, its development still faces challenges such as the need to clarify its legal status, the legitimacy dilemma of organizational entities, and the inadequacies of operational mechanisms, incentive mechanisms, and regulatory mechanisms. This paper, based on the newly revised “Charity Law”, integrates relevant theories such as state-society relations and the public sphere, analyzes the value orientation and local characteristics of community charity, examines the provisions and limitations of the current Charity Law on community charity, and proposes a systematic legal pathway for the development of community charity by drawing on two typical cases from Guangzhou City and Chengdu’s Jinjiang District. It emphasizes that through scientific legislation and standardized governance, community charity should be steadily advanced on the track of the rule of law, making it a vital force for promoting balanced social development and building a harmonious society.
