摘要: “首违不罚”应用于道路交通领域对缓和交通执法冲突、优化交通执法资源配置具有重要意义。但实践中“危害后果轻微”等核心要件认定标准不明确，免罚清单相互冲突，裁量基准不统一，使得道路交通领域“首违不罚”适用面临诸多问题。因此，有必要厘清“首违不罚”各要件的含义，统一清单适用标准，完善相应配套机制，更好发挥“首违不罚”应有之义。

Abstract: The application of “first violation impunity” in the field of road traffic is of great significance for easing traffic law enforcement conflicts and optimizing the allocation of traffic law enforcement resources. However, in practice, the criteria for identifying core elements such as “minor harmful consequences” are not clear, the exemption lists conflict with each other, and the benchmarks for discretion are not uniform, which leads to many problems in the application of “no penalty for the first offense” in the field of road traffic. Therefore, it is necessary to clarify the meanings of each element of “no penalty for the first offense”, unify the applicable standards of the list, improve the corresponding supporting mechanisms, and better play the due role of “no penalty for the first offense”.
