反不正当竞争法与知识产权法的关系探究

Research on the Relationship between the Anti-Unfair Competition Law and Intellectual Property Law

摘要: 知识产权法与反不正当竞争法的边界模糊，是我国知识产权司法实践中长期存在的难题，同人作品、角色元素利用等新型创作行为进一步加剧了法律适用的分歧。本文以实务案例为切入点，结合学界研究成果与最高法反不正当竞争法司法解释，从历史起源到两法之间的关系探讨两法核心差异，批判兜底保护泛化适用的误区，确立专门法优先、反不正当竞争法补充、谦抑适用的规则。现阶段研究明确了著作权法保护独创性表达、反不正当竞争法维护竞争秩序的功能分工，梳理两法适用边界，为新生事物所产生的社会关系，如同人创作、二次利用等行为划定合法空间，平衡原创保护与创作自由，推动知识产权法律体系协调运行与文化产业健康发展。

Abstract: The ambiguity surrounding the interface between Intellectual Property Law and the Anti-Unfair Competition Law has long plagued China’s IP judiciary, a situation compounded by novel creations like fan works and character element exploitation. Grounded in case studies and the Supreme People’s Court’s Judicial Interpretation, this paper examines the historical relationship and core differences between the two laws. It argues against the pan-application of the AUCL as a residual protective measure and advocates for a rule of statutory priority coupled with restrained supplementary application. By clarifying that Copyright Law governs original expression whereas the AUCL maintains competitive order, this research delineates the legal boundaries for secondary creations. This framework balances originality protection with creative freedom, facilitating both the harmonious operation of the IP system and the robust growth of the cultural sector.
