论大数据时代个人信息保护的法律规制研究

Research on the Legal Regulation of Personal Information Protection in the Era of Big Data

摘要: 随着数字技术和数字经济的不断发展，数据在社会生活中的广泛应用，不可避免地会对公民的个人信息安全带来损害，从而难以保护公民基本的数字权益。因此，本文通过大数据时代个人信息的内涵及保护的必要性进行介绍，分析我国当前个人信息保护的现状，对个人信息保护过程中所存在的敏感信息保护力度弱、个人信息保护规则不完善、监管机构难以明确以及监管手段效率低等方面的问题进行分析，来进一步阐明加快保护数字时代个人信息的必要性，为我国个人信息保护的法律制度完善提供一些可行性建议。

Abstract: With the continuous development of digital technology and the digital economy, and the wide application of data in social life, it will inevitably cause harm to citizens’ personal information security, making it difficult to protect citizens’ basic digital rights. Therefore, this paper introduces the connotation of personal information in the era of big data and the necessity of its protection, analyzes the current situation of personal information protection in China, and examines issues in the process of personal information protection, such as weak protection of sensitive information, imperfect personal information protection rules, unclear regulatory authorities, and low efficiency of regulatory methods, in order to further explain the necessity of accelerating the protection of personal information in the digital age and provide some feasible suggestions for improving the legal system of personal information protection in China.
