新业态从业人员劳动权益保障问题研究

摘要: 随着数字经济的不断发展,以平台经济为代表的新业态如雨后春笋般涌现,催生了大量的新型就业岗位,从业人员规模持续扩大,已成为我国就业市场的重要组成部分。但与之相对应的劳动权益保障体系却相对滞后,难以契合新型用工模式,劳动关系模糊、社会保障缺位、维权渠道不畅等问题日益凸显。文章通过分析新业态从业人员劳动权益保障的现状,指出现存问题,在此基础上分别从更新劳动关系认定规则、创新保险法律制度、增强劳动者维权意识等方面提出完善对策,旨在保障新业态从业人员的劳动权益,促进新业态健康可持续发展。
Abstract: With the continuous development of the digital economy, new business models—represented by the platform economy—have sprung up like mushrooms after rain, creating a large number of new jobs. The workforce in this sector continues to expand and has become an important component of China’s employment market. However, the corresponding system for safeguarding labor rights and interests has lagged behind, struggling to adapt to these new employment models. Issues such as ambiguous labor relations, gaps in social security coverage, and inadequate channels for rights protection have become increasingly prominent. By analyzing the current state of labor rights protection for workers in new business models and identifying existing problems, this article proposes improvement strategies in three key areas: updating the rules for determining labor relationships, innovating social insurance legal systems, and enhancing workers’ awareness of their rights. The aim is to safeguard the labor rights of workers in new business models and promote their healthy and sustainable development.
