大学生个人信息保护的法律困境与法治 完善路径

Legal Dilemmas and Legal Improvement Paths for the Protection of College Students’ Personal Information

摘要: 数字校园快速发展下，大学生敏感个人信息被广泛收集流转，侵权风险持续上升。我国已构建起以《中华人民共和国民法典》《中华人民共和国个人信息保护法》为核心的法律体系，但高校场景中仍存在知情同意形式化、主体身份冲突、最小必要原则标准不清等问题，加之第三方侵权、学生法治素养不足，个人信息保护面临诸多挑战。本文结合法律规定与校园实践分析现存困境，并从高校管理、第三方监管、法治教育三方面提出完善对策，以期维护学生信息权益，推进高校治理现代化。

Abstract: With the rapid development of digital campuses, college students’ sensitive personal information is extensively collected and circulated, leading to a continuous rise in infringement risks. China has established a legal system centered on the Civil Code of the People’s Republic of China and the Personal Information Protection Law of the People’s Republic of China. However, colleges and universities are confronted with problems such as formalized informed consent, conflicts of dual identities and ambiguous application criteria for the principle of minimum necessity. Coupled with frequent infringements by third parties and inadequate legal literacy among students, the protection of personal information faces numerous challenges. Combining relevant legal provisions and university practices, this paper analyzes the existing dilemmas and puts forward improvement countermeasures from the perspectives of university management, third-party supervision and legal education, so as to safeguard college students’ rights and interests of personal information and advance the modernization of university governance.
