开源软件生态中的垄断风险及其反垄断法规制研究

摘要: 随着数字经济的深化,开源软件已从非营利性的技术协作工具转型为现代数字基础设施的核心要素与市场准入标准。本文观察到,以Android和Chromium为代表的开源生态在底层代码开放的表象下,已形成显著的高度集中结构,诱发了系统性的垄断风险。研究发现,开源垄断风险的生成机理植根于许可协议的性质转向与商业模式的异化。许可协议已从单纯的权利让渡声明演变为精密的知识资源配置规制工具。通过“低门槛进入、高成本退出”的吸引力法则,主导企业利用网络效应实现生态锁定。同时,现代开源大厂普遍采取“开源引流–闭源变现”的二元结构,利用底层架构的渗透率作为杠杆,将竞争压力传导至闭源的服务层,为实施不合理交易条件提供了制度土壤。在实务审查层面,本文对开源生态中典型的竞争限制行为进行了类型化判定。针对开源模式带来的审查困境,本文提出相关市场界定应从传统的SSNIP测试转向以“接口控制权”和“迁徙成本”为核心的定性分析;在消费者福利分析中,应引入“动态竞争”视角,修正传统静态框架对创新价值评估的局限。最后,本文主张构建“反垄断外部规制与知识产权内部限制”的二元治理架构,通过优化国产协议设计与跨部门协同机制,构建公平竞争的开源生态环境。
Abstract: With the deepening of the digital economy, open source software has evolved from a non-profit tool for technical collaboration into a core component of modern digital infrastructure and a de facto standard for market entry. This paper observes that, despite the appearance of open underlying code, open source ecosystems represented by Android and Chromium have developed a markedly high degree of concentration, giving rise to systemic monopoly risks. The study finds that the formation mechanism of monopoly risks in open source ecosystems is rooted in the transformation of licensing agreements and the distortion of business models. Licensing agreements have evolved from mere declarations of rights transfer into sophisticated regulatory tools for the allocation of intellectual resources. Through the attraction mechanism of “low entry barriers and high exit costs”, dominant firms leverage network effects to achieve ecosystem lock-in. Meanwhile, major contemporary open source corporations generally adopt a dual structure of “open source for traffic acquisition—proprietary monetization”, using the penetration of underlying architectures as leverage to transmit competitive pressure to the proprietary service layer, thereby creating institutional conditions for the imposition of unreasonable trading conditions. At the level of practical enforcement, this paper categorizes typical competition-restricting practices within open source ecosystems. In response to the challenges posed by open source models to antitrust review, it proposes that relevant market definition should shift from the traditional SSNIP test to a qualitative analysis centered on “control over interfaces” and “switching costs”. In analyzing consumer welfare, a “dynamic competition” perspective should be introduced to correct the limitations of traditional static frameworks in evaluating innovation. Finally, the paper advocates for a dual governance framework combining “external antitrust regulation” and “internal constraints of intellectual property law”. By optimizing domestic licensing design and strengthening cross-departmental coordination mechanisms, a fair and competitive open source ecosystem can be fostered.
