生态环境领域行刑衔接的协同治理机制研究

Research on the Collaborative Governance Mechanism of the Interface between Administrative Enforcement and Criminal Justice in the Eco-Environmental Field

摘要: 生态环境领域行刑衔接作为连接行政执法与刑事司法的重要制度，已经逐渐扩展为涵盖责任认定、证据转化、信息共享和部门协作的协同治理机制。当前实践中仍存在行政违法与刑事犯罪边界不清、案件移送与证据转化不畅、多部门协作机制运行效能不足等问题。对此，应当确立罪质与罪量分层审查的案件定性规则，优化案件移送与证据衔接机制，构建常态化多部门协同治理机制，推动行政执法与刑事司法在生态环境治理中形成稳定、高效的衔接关系。

Abstract: As a vital institutional bridge connecting administrative enforcement and criminal justice, the administrative-criminal interface in the eco-environmental field has gradually evolved into a collaborative governance mechanism that encompasses liability determination, evidence conversion, information sharing, and inter-departmental cooperation. In current practice, however, several structural bottlenecks persist, such as the blurred boundaries between administrative violations and criminal offenses, friction in case transfers and evidence conversions, and the suboptimal operational efficiency of multi-departmental collaboration. To address these challenges, this study proposes establishing case characterization rules based on a hierarchical review of offense nature and gravity metrics, optimizing the mechanisms for case transfer and evidence integration, and constructing a normalized multi-departmental collaborative governance framework. Ultimately, these measures aim to foster a stable, smooth, and highly efficient interaction between administrative enforcement and criminal justice within the realm of eco-environmental governance.
