论电子商务平台经营者安全保障义务的法律适用

On the Legal Application of Security Guarantee Obligations of E-Commerce Platform Operators

摘要: 随着数字经济的不断发展，电子商务平台作为商品交易服务的核心载体，其安全保障义务的履行直接关系到消费者合法权益的保护以及市场经济的健康发展。我国在《电子商务法》《民法典》等法律中规定了平台经营者的安全保障义务，但其均存在条文表述模糊、责任边界不明等问题，导致司法实践中出现法律适用混乱、同案不同判等现象。故本文以平台安全保障义务的法律性质为出发点，结合现行立法背景下典型案例存在的适用困境，从法律规则的角度提出电子商务平台经营者安全保障义务法律适用的完善路径，以期实现平台责任与消费者保护之间的平衡。

Abstract: With the continuous development of the digital economy, e-commerce platforms, as the core carriers of commodity trading services, their fulfillment of security guarantee obligations directly relates to the protection of consumers’ legitimate rights and interests and the healthy development of the market economy. China has stipulated the security guarantee obligations of platform operators in laws such as the “E-commerce Law” and the “Civil Code”, but these laws all have problems such as ambiguous wording and unclear boundaries of responsibility, leading to phenomena such as chaotic application of law and inconsistent judgments in the same case in judicial practice. Therefore, this article starts from the legal nature of the security guarantee obligations of the platform, combines the application difficulties of typical cases under the current legislative background, and proposes the improvement path of the legal application of the security guarantee obligations of e-commerce platform operators from the perspective of legal rules, in order to achieve a balance between platform responsibility and consumer protection.
