A Study on Conflicts in the Application of the “De Minimis” Provision under the RCEP Rules of Origin

摘要: 本文聚焦RCEP原产地规则中的“微小含量”条款，通过解析条款法律内涵与梳理真实贸易纠纷，系统探讨该条款在国家执行标准、产业适配性及贸易规则衔接中的现实冲突。结合具体贸易案例，深入分析冲突产生的制度根源与经济影响，并从路径优化和制度完善两个维度提出解决方案，为完善区域原产地规则体系、提升贸易便利化水平提供实践参考。

Abstract: This paper centers on the “De Minimis” provision contained in the RCEP Rules of Origin. By interpreting the legal connotation of the provision and sorting out real trade disputes, it systematically discusses practical conflicts arising from the provision in terms of national implementation standards, industrial adaptability and coordination of trade rules. Combined with specific trade cases, this paper further analyzes the institutional root causes and economic impacts of such conflicts, and puts forward countermeasures from two dimensions of path optimization and institutional improvement. It provides practical references for optimizing the regional rules of origin system and advancing trade facilitation.
