On the Criminalization and Governance of Illegal Hunting

摘要: 文章通过分析当前非法狩猎案件在立法、司法和社会治理三个层面的问题，深入探讨了其背后的成因，并从规范司法尺度、构建多层次治理机制、强化犯罪预防三个方面提出了系统解决方案，旨在统一非法狩猎案件司法裁量尺度，实现从单一“治罪惩戒”向多元“系统治理、源头治理、生态治理”的模式转型，完善野生动物资源刑法保护体系。文章认为，非法狩猎案件的治理需要在宽严相济刑事政策指导下，实现从“治罪”到“治理”的模式转变。

Abstract: By analyzing the problems existing in current illegal hunting cases from three dimensions of legislation, judicature, and social governance, this paper thoroughly explores the underlying causes, and puts forward systematic solutions from three perspectives: standardizing judicial discretion, establishing multi-level governance mechanisms, and strengthening crime prevention. It aims to unify the judicial measurement standards for illegal hunting cases, realize the model transformation from single “criminal punishment” to diversified “systematic governance, source governance and ecological governance”, and perfect the criminal law protection system for wildlife resources. This paper holds that the governance of illegal hunting cases should shift its model from “criminalization” to “comprehensive governance” under the guidance of the criminal policy of tempering justice with mercy.
