A Study on the Application of the Foreseeability Rule in Equitable Infringement

摘要: 对可预见性规则尚存的缺陷进行剖析，选取可预见性规则的要件逻辑存在瑕疵、可预见性规则增加专利撰写负担、可预见性规则与捐献原则存在竞合三个问题展开剖析，并从明确可预见性规则的要件内涵、明晰权利要求书撰写的边界、把握可预见性规则与捐献原则之间的关系三个方面进行分析，以期完善可预见性规则的司法适用。

Abstract: This paper analyzes the existing flaws in the foreseeable rule, focusing on three issues: the flawed logic of its essential elements, the increased burden it imposes on patent drafting, and its potential conflict with the doctrine of surrender. It further examines these aspects from three perspectives—clarifying the connotation of the foreseeable rule’s essential elements, defining the boundaries of claim drafting, and understanding the relationship between the foreseeable rule and the doctrine of surrender—to propose improvements in the judicial application of the foreseeable rule.
