数字经济背景下电商人才流动限制的反垄断规制研究

Research on Antitrust Regulation of E-Commerce Talent Mobility Restrictions under Digital Economy Background

摘要: 数字经济时代，电子商务平台已成为驱动行业发展的核心载体，平台间、平台与生态内主体间达成的人才流动限制协议，本质上是平台利用市场支配地位与数据优势实施的横向垄断行为，不仅严重扭曲电商劳动力市场竞争秩序，还侵害广大电商从业者的择业自由权、劳动报酬权与职业发展权。应立足电商平台用工场景的特殊性，以保障劳动者权益为核心立场，剖析平台主导的人才流动限制行为的垄断属性与对劳动者权益的损害，明确平台主体的反垄断合规义务，既通过反垄断执法破除平台对劳动力市场的垄断壁垒，又以劳动者权益保护为根本导向，推动电商行业实现公平竞争与劳动者权益保障的协同发展，为数字经济背景下电商劳动力市场的健康有序发展提供法治保障。

Abstract: In the digital economy era, e-commerce platforms have become the core drivers of industrial development. Restriction agreements on talent mobility between platforms and within their ecosystems essentially constitute horizontal monopolistic practices where platforms leverage market dominance and data advantages. These arrangements not only severely distort competition in the e-commerce labor market but also infringe upon workers’ rights to employment freedom, fair compensation, and career advancement. This study examines the monopolistic nature of platform-led talent mobility restrictions and their detrimental impacts on worker rights, grounded in the unique employment dynamics of e-commerce platforms. By prioritizing labor rights protection, it clarifies platforms’ antitrust compliance obligations. The approach aims to dismantle market barriers through regulatory enforcement while fostering coordinated development of fair competition and worker safeguards within the e-commerce sector, thereby providing legal safeguards for the healthy and orderly evolution of e-commerce labor markets in the digital economy landscape.
