The Judicial Application of System Interpretation

摘要: 本文从体系解释的概念和起源开篇，指出了体系解释的内部体系和外部体系。介绍了体系解释的五大原则，即无矛盾原则、无赘言原则、体系秩序原则、无漏洞原则及法秩序统一性原则，辅之同一律规则和同类解释规则形成体系解释的规则，提倡恰当地运用体系解释，充分发挥各种解释方法的功能，实现法律正义。

Abstract: This article begins with the concept and origin of systemic interpretation, pointing out the internal and external systems of systemic interpretation. It then proposes five major principles of systemic interpretation, including the principle of non-contradiction, the principle of no redundancy, the principle of system order, the principle of no loopholes, and the principle of unity of legal order, supplemented by the rule of identity and the rule of analogous interpretation to form the rules of systemic interpretation. It advocates the appropriate application of systemic interpretation, giving full play to the functions of various interpretive methods to achieve legal justice.
