网络暴力刑法规制的困境及应对

Study on Criminal Law Regulatory Dilemma and Its Response to Cyber Violence

摘要: 随着互联网时代的发展，网络暴力成为日渐突出的问题，网络暴力行为以其独有的特征与我国现有罪名不能完全兼容，因此探索网络暴力行为的刑法规制具有一定的研究价值。通过比较法对日本应对网络暴力的刑法措施进行分析，以期为我国提供借鉴。我国网络暴力的刑法规制，应当通过明确入罪标准、提高法定刑；规制网络“暴力”范围和言论自由界限；利用刑法解释对“二次公开”行为进行补充界定。将网络暴力合理纳入现有罪名之中，维护网络世界的安全。

Abstract: With the development of the Internet era, cyber violence has become an increasingly prominent problem. Cyber violence, with its unique characteristics, is not fully compatible with the existing crimes in China, so it is of certain research value to explore the criminal law system of cyber violence. We analyze Japan’s criminal law measures to cope with cyber violence through comparative law, in order to provide a reference for China. The criminal law system for cyber violence in China should clarify the criminalization standard and increase the legal penalty; regulate the scope of cyber “violence” and the boundary of freedom of expression; and use criminal law interpretation to supplement the definition of “secondary public” behavior. Cyberviolence should be reasonably incorporated into existing crimes, so as to maintain the safety of the cyberworld.
