人工智能生成内容的独创性判断与著作权归属规则重构

Originality Judgment of Content Generated by Artificial Intelligence and Reconstruction of Copyright Ownership Rules

摘要: 随着生成式人工智能技术的迅猛发展，个人智能生成内容(AIGC)的著作权问题日益凸显，已经成为版权法领域最具时代挑战性的问题。本文从作品独创性判断标准出发，系统分析了当前AIGC在著作权法框架下的核心困境，包括独创性认定标准模糊，权利归属主体不明，侵权风险难以界定等问题。通过对国内外典型案例和立法实践的比较研究，本文提出应以“人类中心主义”为原则，在坚守著作权法人本根基的同时，构建层次化的独特性判断标准和归属规则体系，以期为人工智能时代的著作权制度完善提供理论参考和实践路径。

Abstract: With the rapid development of generative artificial intelligence technology, the copyright issue of Artificial Intelligence (AI) produced content has become increasingly prominent and has become the most challenging problem in the field of copyright law. Starting from the criteria for judging the originality of works, this article systematically analyzes the core challenges of AI production content (AIGC) under the framework of copyright law, including vague standards for determining originality, unclear ownership of rights, and difficulty in defining infringement risks. Through comparative research on typical cases and legislative practices at home and abroad, this article proposes that “anthropocentrism” should be taken as the principle, while adhering to the foundation of copyright legal person, a hierarchical system of uniqueness judgment standards and attribution rules should be constructed, in order to provide theoretical reference and practical path for the improvement of copyright system in the era of artificial intelligence.
