跨境电商知识产权纠纷在线仲裁解决机制研究

Research on the Online Arbitration Resolution Mechanism for Intellectual Property Disputes in Cross-Border E-Commerce

摘要: 我国跨境电商产业快速发展的同时，领域内知识产权纠纷频发，传统诉讼面临专业性不足、结案周期长、维权成本高等现实困境。在线仲裁虽高度适配此类纠纷的数字化与时效性需求，却仍受制于临时措施的路径分歧、知识产权有效性争议的可仲裁性争议、“涉外 + 知识产权”双重属性下专门性规则缺位的三重制度障碍。本文在剖析三重困境生成机理的基础上，提出完善裁审衔接数字化机制、构建行政–仲裁协同机制、制定专门仲裁规则三条完善路径。同时客观研判各项制度方案实施过程中可能遭遇的现实挑战，为跨境电商企业海外维权及我国仲裁制度创新提供参考。

Abstract: Alongside the rapid growth of China’s cross-border e-commerce industry, intellectual property disputes have been on a frequent rise within this sector. Traditional litigation is plagued by practical bottlenecks including insufficient professional competence, lengthy case-closing cycles and high costs for rights enforcement. While online arbitration is well-suited to the digital and time-sensitive nature of such disputes, it remains constrained by three institutional hurdles: divergences concerning interim measures, controversies over the arbitrability of intellectual property validity disputes, and the lack of specialized arbitration rules amid the dual attributes of “foreign-related elements and intellectual property rights”. By analyzing the formative mechanisms behind these three-fold dilemmas, this paper puts forward three improvement approaches: optimizing the digitalized mechanism for arbitration-judiciary linkage, establishing an administration-arbitration coordination mechanism, and formulating specialized arbitration rules. It also objectively assesses practical challenges that may arise in implementing each institutional proposal, so as to provide references for Chinese cross-border e-commerce enterprises in overseas rights protection and for the institutional innovation of China’s arbitration system.
