Judicial Practice Review and Justification for Active Application of Skiing Rules

摘要: 随着以吉林省为代表的冰雪资源富集地区正着力发展冰雪产业，推动相关经济持续增长，但相伴而来的滑雪伤害纠纷也日益增多。当前司法实践反映出，当前司法实践在处理此类侵权案件时，暴露出过错认定与责任划分缺乏清晰、统一的裁判标准等问题。若此类司法适用问题未能得到妥善解决，势必会影响冰雪经济健康发展目标的实现。解决问题的关键在于，将滑雪规则系统性地、规范化地纳入侵权责任认定体系，实现其从“软规范”到“硬约束”的司法转化，为同类纠纷提供稳定、可预期的裁判基准，从而引导滑雪运动实现可持续发展。

Abstract: As regions rich in ice and snow resources, such as Jilin Province, are actively developing the ice and snow industry, while contributing to sustained economic growth, the number of disputes related to skiing injuries has also been increasing. Current judicial practices reveal shortcomings in handling such tort cases, particularly the lack of clear and consistent standards for determining fault and allocating liability. If these issues in judicial application are not properly resolved, they will inevitably hinder the realization of a healthy development goal for the ice and snow economy. The key to resolving this lies in systematically and standardly integrating skiing rules into the framework of tort liability determination, transforming them from “soft norms” into “hard constraints” through judicial practice. This would provide stable and predictable legal benchmarks for similar disputes, thereby guiding the sustainable development of skiing activities.
