银发经济背景下老年旅游者权益保障研究

Research on the Protection of the Rights and Interests of Elderly Tourists in the Context of Silver Economy

摘要: 银发旅游是银发经济中极具活力的重要组成部分，在当前大力推动银发经济高质量发展的政策背景下，银发旅游产业正朝着品质化、数字化的方向转型升级。然而，当前银发旅游市场仍普遍存在因信息不对称陷入消费陷阱、不平等免责协议、个人信息安全保障不足、数字服务适老化改造不到位等权益保障困境，有碍于老年人的社会参与。对此，需要坚持多措并举、多主体协同发力，通过健全行业服务标准、实施分级分类监管制度、建立多部门协同监管机制、构建社群互助保障体系等措施予以应对，为老年群体通过旅游方式参与社会生活和社会发展提供有效保障，更好地促进积极老龄化理念的落实。

Abstract: Silver tourism is a highly dynamic and important component of the silver economy. Against the current policy backdrop of vigorously promoting the high-quality development of the silver economy, the silver tourism industry is undergoing a transformation and upgrading towards quality and digitalization. However, the current silver tourism market still faces widespread challenges in protecting rights and interests, such as falling into consumption traps due to information asymmetry, unequal exemption agreements, inadequate protection of personal information security, and inadequate digital service adaptations for the elderly, which hinder the social participation of the elderly. To address this, it is necessary to adhere to a multi-pronged approach and collaborative efforts among multiple stakeholders. Measures such as improving industry service standards, implementing a graded and classified supervision system, establishing a multi-departmental collaborative supervision mechanism, and constructing a community mutual aid and security system should be taken to provide effective guarantees for the elderly group to participate in social life and social development through tourism, thereby better promoting the implementation of the concept of active aging.
