乡村振兴背景下农村社会救助法律体系构建研究——以河南省农村为研究对象

Research on Building the Legal System for Rural Social Assistance in the Context of Rural Revitalization—Taking Rural Areas of Henan Province as the Research Subject

摘要: 乡村振兴战略的全面推进对农村社会救助制度提出了从“根本保障”向“赋能发展”转型的新要求。当前的农村社会救助法律体系建设虽已取得显著成效，但仍面临诸如立法层级偏低、制度衔接不畅、精准识别困难、乡村振兴战略融合不足等问题。本文以河南省农村为例，在梳理农村社会救助法律制度相关文献的基础上，结合河南省近年来的政策实践与典型案例，分析了河南省农村社会救助法律体系建设的现状与困境，提出“提升立法层级、推进城乡统筹、强化精准执行、促进政策衔接、健全配套机制”等系统性对策，以期为乡村振兴背景下农村社会救助法律体系的优化和完善提供理论参考。

Abstract: The comprehensive push of the rural revitalization strategy has brought new demands to the rural social assistance system, shifting it from just a “basic guarantee” to more of a “development engine”. However, there has been significant progress in building the legal framework for rural social assistance, there are still challenges such as low legislative levels, poor system coordination, difficulties in precise identification, and insufficient integration with the rural revitalization strategy. In the present work, taking rural areas in Henan Province as an example, reviews relevant literature on rural social assistance laws, looks at recent policies and typical cases in Henan, and analyzes the current state and challenges of the rural social assistance legal system there. Then, some proposals for systematic measures, such as “raising the legislative level, promoting urban-rural coordination, strengthening precise implementation, improving policy coordination, and developing supporting mechanisms” and so on, were presented, aiming to provide a theoretical reference for optimizing and improving the rural social assistance legal system under the context of rural revitalization.
