中外动漫形象商品化权法律保护的比较

摘要: 动漫产业作为新兴文化创意产业,其快速发展带来了可观的经济效益,但在司法实践中侵犯动漫作品中人物形象的案件也频频发生。虽然我国在知识产权法律体系中有法律条文能够对此进行相应保护,但由于我国现行法律中没有商品化权的概念,因此现有保护体系并不完善。通过对比中外有关于动漫形象商品化权的研究,在民法典编纂之际,对完善我国动漫形象商品化权的法律保护提出若干建议,期望我国的动漫产业能够得到进一步的发展。
Abstract: Animation industry as a new cultural creative industry, its rapid development has brought considerable economic benefits, but the infringements of cartoon characters in the case also occur frequently in judicial practice. Although China has made some corresponding protections in the intellectual property legal system, this protection system is not perfect because of the absence of the concept of merchandising right in our current laws. By the comparison of the Chinese and foreign studies on the merchandising rights of cartoon image, on the occasion of the codification of civil law, this paper puts forward suggestions on perfecting the legal protection of merchandising rights ,hoping the development of China's animation industry can be better.
