关于对海事行政处罚执行过程若干问题的思考
Reflections on the Implementation of Maritime Administrative Penalty
摘要:
近年来,随着中国海上运输和经济活动以及沿海港口码头建设的快速发展,海上活动日益频繁,由此也带来了海上险情和事故数量的逐年上升,给海事安全监管所带来的压力不断加大,海事行政处罚也呈逐年上升的趋势1。随着2018年交通运输部海事法制信息系统的正式上线运行,借助信息化手段和标准流程设计,海事行政处罚行为规范化水平有了明显提升,但结合笔者调阅海事行政处罚案卷情况来看,发现以往不易引起重视的处罚执行阶段却成为引发潜在海事执法风险的集中区域。
Abstract:
In recent years, as China’s maritime transport and economic activities are becoming more and more frequent, which poses a marine risk rise year by year and brings pressure increasing to the maritime safety supervision, and the maritime administrative punishment also shows a trend of rising year by year. With the aid of information means and perfect design, the maritime adminis-trative punishment behavior standardization level has improved significantly, but the punishment implementation stage which is not easy to cause attention has become a focus area of maritime law enforcement potential risk.
