Research on Network Intellectual Property Protection

摘要: 伴随着互联网的迅猛发展，此起彼伏的网络知识产权纠纷显示出网络知识产权保护的脆弱与空白，构建完善的网络知识产权保护司法规则对网络知识产权纠纷进行调整、加以规制，具有较强的现实意义。本文首先对我国立法及司法实践中网络知识产权保护的现状进行具体阐述；其次，通过比较分析的方法，立足于国际网络知识产权保护的认识，从立法和司法两个维度出发，就本土网络知识产权保护规则现有困境进行原因分析；最后，建构具有系统性、前瞻性，兼有一定弹性和原则性的网络知识产权保护规则。

Abstract: With the rapid development of the Internet, the network intellectual property disputes show the weakness and blank of the network intellectual property protection. Constructing perfect judicial rules of the network intellectual property protection has a strong practical significance. Firstly, this paper expounds the current situation of the network intellectual property protection in the legislation and judicial practice of our country. Secondly, through the method of comparative analysis, based on the understanding of international network, intellectual property protection, starting from the two dimensions of legislation and judicature, this paper analyzes the reasons of the existing dilemma; finally, constructs a systematic, forward-looking, flexible and principled network intellectual property protection rule.
