论局部外观设计的专利保护

On the Patent Protection of Partial Appearance Design

摘要: 在国家知识产权局于2015年4月发布的针对专利法进行的第四次修改草案征求意见稿的第二条中，修改了外观设计的定义，首次引入了局部设计概念，将其区别于整体外观设计。由此，无论是业界还是学界对此都极度关注，认为这一实践是我国外观设计专利保护制度的一大重要发展。实际上，美国、日本、韩国等国家早已对局部外观设计有了保护制度。现拟从我国现行法律缺乏局部外观设计保护制度的角度出发，论证分析我国引入局部外观设计专利保护的正当性、必要性和可行性，由此进一步给出有关的制度构建。

Abstract: In April 2015, article 2 of the draft for soliciting comments on the fourth revision of the patent law published by the state intellectual property office revised the definition of design, introducing the concept of partial design for the first time and distinguishing it from the overall design. Therefore, both the industry and the academic community are extremely concerned about this practice, that is, China’s design patent protection system is an important development. In fact, the United States, Japan, South Korea and other countries already have a protection system for local appearance de-sign. It is proposed to analyze the legitimacy, necessity and feasibility of introducing partial design patent protection in China from the perspective of the lack of partial design protection system in China’s current laws, and further provide relevant system construction.
