日本明治时期法律文化对法律移植的影响探究

Research on the Impact of Legal Culture on Legal Transplantation in Japan Meiji Period

摘要: 日本明治维新时期的法律移植深受当时的法律文化影响。其传统法律文化是中国文化与其本土文化相杂糅的结果，其中武家法原理、武士道精神、家族社会原理均在明治时期的法律移植当中有所体现，可见有效地将西方法律与本土法律文化相结合是法律移植成功的关键。

Abstract: The legal transplantation in Japan during the Meiji Restoration period was deeply influenced by the legal culture at that time. Its traditional legal culture is the result of a mixture of Chinese culture and its local culture. Among them, the principles of martial law, the spirit of Bushido, and the prin-ciples of family society are all reflected in the legal transplantation of the Meiji period. It can be seen that the effective combination of Western law and local legal culture is the key to the success of legal transplantation.
