论公路运输物流企业的环境法律责任

On the Environmental Legal Liability of Road Transportation Logistics Enterprises

摘要: 与其他物流活动相比，公路运输活动中物流企业有承担环境法律责任的特殊性。企业成本控制与运输成本上涨的矛盾，政府监管难等原因，公路运输对环境产生一些负面影响。分析公路运输物流企业缺失环境法律责任的原因及影响，提出一些法治建议，如健全公众参与制度、政府加强监管，划分不同等级物流企业的环境法律责任等。以帮助公路运输物流企业提高承担环境法律责任的自觉性，减少资源浪费，保护环境。

Abstract: Compared with other logistics activities, logistics enterprises have the particularity of undertaking environmental legal liability in road transport activities. The contradiction between enterprise cost control and transportation cost increase, the difficulty of government regulation and other reasons, road transportation has some negative effects on the environment. This paper analyzes the causes and effects of the lack of environmental legal liability of road transport logistics enterprises, and puts forward some suggestions on the rule of law, such as improving the public participation system, strengthening the government supervision, and dividing the environmental legal liability of different logistics enterprises to help the road transport logistics enterprises to improve the awareness of environmental legal responsibility, reduce the waste of resources, to protect the environment.
