侵害宠物可提起精神损害赔偿的法律制度完善

The Improvement of the Legal System of Mental Damage Compensation for Infringement of Pets

摘要: 随着我国动物保护水平的提升，饲养宠物的人数越来越多，人类与宠物之间的情感关系越来越紧密，宠物身上具有一定的人格利益，承载着饲养人的情感利益，在宠物受到侵害时饲养人会产生巨大的精神损失。但是在宠物侵害精神损害赔偿还面临着许多困境。随着近年来涉及宠物伤害财产纠纷案件的越来越多，为了体现社会公平和法律的人文关怀，我国应秉持必要和适度的原则，将符合一定标准的宠物认定为《民法典》侵权责任编中“具有人身意义的特定物”，确立可提起侵害宠物精神损害赔偿的责任构成，扩大精神损害赔偿的适用范围。

Abstract: With the improvement of the level of animal protection in China, more and more people keep pets, and the emotional relationship between human beings and pets is getting closer and closer. Pets have certain personality interests and bear the emotional interests of the breeders. When pets are infringed, the breeders will have a huge spiritual loss. However, there are still many difficulties in the compensation for the spiritual damage of pets. With more and more cases involving pet injury property disputes in recent years, in order to reflect social equity and legal humanistic care, China should adhere to the principle of necessity and moderation, identify pets that meet certain stan-dards as “specific objects with personal significance” in the tort liability of civil code, establish the liability composition of compensation for spiritual damage of pets, and expand the scope of appli-cation of mental damage compensation.
