在线开放课程著作权问题探讨——以《创业之路——带你玩转设计思维》课程为例

On the Copyright of Online Open Courses—Taking the Course “The Road of Entrepreneurship: Taking You to Play Design Thinking” as an Example

摘要: 近年来，国内各类在线课程数量逐年增加，在教育行业逐步普及，受益者众多，但相应著作权保护问题尚未得到足够重视。本文旨在基于课程建设中涉及的几类利益相关者间的关系，探讨目前在线开放课程中突出存在的几个著作权归属问题，在作品保护与合理使用之间取得平衡——首先，从在线开放课程的定义和受著作权保护的客体范围界定入手，列举课程开发、运营及服务过程中可能涉及的利益相关者，并探讨利益相关者间的关系，进而梳理目前在线开放课程主要面临的著作权问题，最后以一门建设成熟的创新创业类在线开放课程《创业之路——带你玩转设计思维》为例进行案例剖析，旨在基于著作权所有者权益保护的前提下，促进课程信息资源的共享与合理使用，提高知识资源传播与利用率，加快在线开放课程建设与发展的脚步。

Abstract: In recent years, the number of various online courses in China has increased year by year, gradually popularized in the education industry, and many beneficiaries, but the corresponding copyright protection issues have not been paid enough attention. Based on the relationship between several kinds of stakeholders involved in the course construction, this paper aims to explore several outstanding problems of copyright ownership in the current online open courses, so as to achieve a balance between the protection of works and the rational use of works. Firstly, starting with the definition of online open courses and the scope of objects protected by copyright, this paper lists the problems in the process of curriculum development, operation and service. This paper discusses the relationship between stakeholders, and then combs the copyright problems faced by the current online open courses. Finally, it takes a mature online open course of innovation and entrepreneurship “The Road of Entrepreneurship—Playing with Design Thinking” as an example to analyze the case, aiming to promote the curriculum trust under the premise of copyright owners’ rights and interests protection. The sharing and rational use of information resources can improve the dissemination and utilization of knowledge resources, and accelerate the construction and development of online open courses.
