生态环境损害赔偿诉讼性质的思考

Reflection on the Litigation Nature of Compensation for Ecological Environmental Damage

摘要: 生态环境损害赔偿诉讼是继环境民事公益诉讼之后出现的新型诉讼类型，目前官方宣布生态环境损害赔偿诉讼本质是环境民事私益诉讼。本文结合《民法典》的侵权责任编第七章1234、1235的相关规定探讨生态环境损害赔偿诉讼的性质，对生态环境损害赔偿诉讼的性质现有学说进行评析，探讨得出生态环境损害诉讼实质是特殊的环境公益诉讼，并提出对生态环境损害赔偿诉讼的完善意见。

Abstract: The litigation of compensation for ecological environmental damage is a new type of litigation after the environmental civil private interest litigation. At present, it is officially announced that the na-ture of the litigation of compensation for ecological environmental damage is the environmental civil public interest litigation. Based on the tort liability of the Civil Code Chapter 7, 1234, 1235 to discuss the relevant provisions of the ecological environment compensation litigation, this paper reviews the existing theories about the nature of compensation for ecological environmental dam-age, concludes that ecological environment damage litigation essence is the special environmental public interest litigation, and puts forward the advice to the improvement of the ecological envi-ronment compensation lawsuit.
