摘要: 公平竞争审查第三方评估制度是对公平竞争自我审查制度的补充与完善，由于第三方评估主体的中立性和客观性，能够为政策制定机关提供更加客观真实的评估报告。然而第三方评估主体的法律地位、权利义务、法律责任等问题均没有得到明确，使得在实践中第三方评估制度的引入存在一定的困境。第三方评估主体辅助政策制定机关的公平竞争审查工作，享有独立评估权、获取信息权和退出权，同时也负有保密义务、中立义务、恪尽职守义务和公开义务。虽然第三方评估主体不对政策措施的制定起决定作用，但深入了解第三方评估主体的相关问题，是维护公平竞争的市场秩序，推动公平竞争审查制度深入实施的题中应有之义。

Abstract: The third-party evaluation system of fair competition review is a supplement and improvement to the self-review system of fair competition. Due to the neutrality and objectivity of the third-party assessment subject, it can provide decision makers with a more objective and true assessment re-port. However, the legal status, rights and obligations, and legal responsibilities of the third-party assessment subject have not been clearly reflected. Therefore, it is difficult to introduce a third-party evaluation system in practice. Third-party assessment bodies assist decision-making bodies in conducting fair competition reviews, enjoy independent assessment rights, information access rights and withdrawal rights, and assume confidentiality, neutrality, due diligence and dis-closure obligations. Although the third-party assessment subject has no decisive role in the formu-lation of policies and measures, it is necessary to understand the relevant issues of the third-party assessment subject to maintain fair competition in the market order and promote fair competition, and in-depth implementation of the fair competition review system.
