地方立法的发展与地方立法权的规制

The Development of the Local Legislation and the Regulation of the Local Legislative Power

摘要: 随着我国法律体系的不断完善，在上位法的规定之下进行细化、解释法律法规的地方立法也迎来了新的发展。明确中央和地方的权力分工，明确地方事务的范围，对于地方立法的进一步发展显得尤为重要。新修订的行政处罚法对于地方性法规补充设定行政处罚权做出了规定，强调适当扩大地方性法规设定行政处罚的权限是非常必要的，由此也看出了地方立法的重要性。关于地方立法首先应当明确地方立法所要解决的地方事务，然后最重要的就是明确其上位法的要求，不得超越法律权限制定地方性法规；但也不能一味的套用上位法的相关条文而不做出任何解释和细化。本文旨在探讨当前地方立法存在的弊端并通过解读行政处罚法修订草案的相关解释来探究地方立法未来的发展方向。

Abstract: With the continuous improvement of China’s legal system, the local legislation that refines and in-terprets the laws and regulations also has welcomed a new development. It is particularly im-portant for the further development of local legislation to clarify the division of power between the central and local governments and to clarify the scope of local legislation. The newly revised Ad-ministrative Punishment Law stipulates on the right to supplement administrative punishment in local regulations, emphasizing that it is very necessary to appropriately expand the authority of lo-cal regulations to set administrative punishment, which also shows the importance of local legisla-tion. On the local legislation, we should first clarify the local affairs which the local legislation needs to solve, and then the most important thing is to clarify the requirements of its superior law, and shall not exceed the legal authority to formulate local regulations; but also cannot blindly apply the relevant provisions of the superior law without making any explanation or refinement. This paper aims to explore the disadvantages of the current local legislation and explore the future develop-ment direction of the local legislation by interpreting the relevant interpretation of the revised draft of the Administrative Punishment Law.
