Extraterritorial Application of Legislation on Cross-Border Data Flow in Europe and America and China’s Causes

摘要: 云计算、大数据、人工智能等新一代信息技术的发展和应用，数据的经济和社会价值日益凸显，数据跨境流动的规模也日益增多。各国在数据跨境流动方面的立法也呈现出扩张的趋势，其主张本国有关数据保护的法律可以域外适用。本文对跨境数据流动法律的域外适用的合法性进行论证，同时根据欧盟、美国的法律中的法律规定，阐述了其在有关域外适用的标准变化。最后，对我国在跨境数据流动方面立法存在的问题进行了分析，并提出完善建议。

Abstract: With the development and application of new generation information technologies such as cloud computing, big data and artificial intelligence, the economic and social value of data has become in-creasingly prominent, and the scale of data cross-border flow is also increasing. Countries’ legisla-tion on cross-border data flow also shows an expanding trend, and they advocate that their laws on data protection can be applied outside the country. This paper demonstrates the legitimacy of ex-traterritorial application of cross-border data flow laws, and expounds the standard changes of ex-traterritorial application according to the legal provisions of European Union and American laws. Finally, the paper analyzes the problems existing in the legislation of cross-border data flow in Chi-na, and puts forward some suggestions for improvement.
