论《海商法》修改背景下内河货物运输的立法模式

Study on the Legislative Mode of Inland River Cargo Transportation under the Background of the Revision of Maritime Law

摘要: 内河运输作为现代综合运输系统中的一个重要组成部分，在我国现代化运输中起到举足轻重的作用。在我国对外开放的影响力愈来愈强盛的今天，国内航运市场也渐渐增强其自身与国际海运的联系，内河运输肩负着更为显著的时代要求。然而自2016年《国内水路货物运输规则》被明文废除后，规范内河货物运输活动的法律实际上处于空白状态，借此修改《海商法》的契机，本文将探讨内河货物运输纳入到《海商法》的调整范围的可能性。

Abstract: As an important part of the modern integrated transport system, inland river transport plays an important role in China’s modern transport. Nowadays, the influence of China’s opening to the outside world is becoming stronger and stronger, and the domestic shipping market is gradually strengthening its own connection with international shipping, and inland river transportation is shouldering more significant requirements of the times. However, since 2016, when The Regulations on the Transport of Goods by Inland Waterways were abolished, the laws regulating the transport of goods by inland waterways are actually in a blank state. Taking the opportunity of revising the Maritime Law, this paper will discuss the possibility of bringing the transport of goods by inland waterways into the adjustment scope of the Maritime Law.
