论WTO框架下“公共机构”的认定标准及我国的应对

摘要: “公共机构”是构成补贴的关键前提，但WTO立法中却没有对此作出明确规定，各国也未对“公共机构”的定义达成一致。“公共机构”的界定关系到国有企业和国有银行等的定性问题，对我国的国家利益和国际贸易实践有深刻影响，因此针对“公共机构”认定标准的探讨至关重要。
Abstract: The public body is a prerequisite for constituting subsidies, however, there is no clear provision of a public body in WTO legislation, and states have not agreed on the meaning of it. The definition of a public body is related to the characterization of state-owned enterprises and state-owned banks, hence having a profound impact on China’s national interests and international trade practices. Therefore, it is crucial to discuss the legal standard for public body determinations.
