论社区矫正的定位

On the Orientation of Community Correction

摘要: 至今我国对社区矫正的定位仍然没有定论，《社区矫正法》也没有对此做出回答。社区矫正的性质，是决定能否科学构建具有中国特色的社区矫正制度的基本问题。笔者通过分析国外社区矫正的地位，以及国内学者的主要观点，认为社区矫正应该定性为“非监禁措施”。

Abstract: So far, the positioning of community corrections in China is still inconclusive, and the Community Correction Law has not responded to this. The nature of community corrections is the basic issue that determines whether a community corrections system with Chinese characteristics can be scientifically constructed. By analyzing the status of community corrections abroad and the main views of domestic scholars, the author believes that community corrections should be defined as a “non-custodial measure”.
