法理学视野下的立法话语逻辑

The Logic of Legislative Discourse from the Perspective of Jurisprudence

摘要: 法理学视野下立法逻辑的视角转换，是从线性的文本逻辑向复调的话语逻辑的转变。立法法理学的精细化研究，承载于以立法话语逻辑为主线的科学立法逻辑。在此主线下，借助立法起草的语言逻辑研究，法律词项的明晰性、法律命题恰当性和稳定性以及法律体系的完备性、一致性和可判定性等问题得以重新讨论。将立法意图纳入话语逻辑的分析框架，以话语实践过程整合多种立法意图，可以重构语言学视角下的话语意图、施事意图和取效意图，更好达至立法过程阐释的融贯一体。立法话语逻辑的总体勾勒，可助力新兴立法法理学的范式重构，同时推动法学话语的深入研究。

Abstract: The perspective transformation of legislative logic from the perspective of jurisprudence is the transformation from linear text logic to polyphonic discourse logic. The refined study of legislative jurisprudence is carried out in scientific legislation with the logic of legislative discourse as the mainline. Under this mainline, with the help of linguistic logic research in legislative drafting, issues such as the clarity of legal terms, the appropriateness and stability of legal propositions, and the completeness, consistency and decidability of the legal system can be re-discussed. Incorporating legislative intent into the analytical framework of discourse logic and integrating multiple legisla-tive intents in the process of discourse practice can reconstruct discourse intent, acting intent and effectual intent from the perspective of linguistics, and better achieve the coherence of legislative process interpretation. The general outline of the logic of legislative discourse can help to recon-struct the paradigm of emerging legislative jurisprudence, and at the same time promote the in-depth study of jurisprudence discourse.
