法与道德的关系探究——《洞穴奇案》引发的思考

Research on the Relationship between Law and Morals—A Reflection from The Case of the Speluncean Explorers

摘要: 伴随着我国经济社会的逐渐发展以及国家法制建设体系的逐渐构成，法与道德间的辩证关系越来越成为法哲学领域的一个关键课题。对此，文章以《洞穴奇案》为切入点，基于法律与道德的基本含义，从多个角度分析了法与道德的辩证关系，同时也对现阶段我国法律与道德发生冲突的问题作出了初步的原因探究与协调建议。

Abstract: With the gradual development of China’s economic society and constitution of the national legal system, the relationship between law and morals has increasingly become a key issue in the field of legal philosophy. Taking The Case of the Speluncean Explorers as an entry point, this paper analyzes the dialectical relationship between law and morals from multiple perspectives, and explores the causes of the conflict in China at this stage to give some initial proposals for the coordinated devel-opment.
