浅议夫妻婚后房产的权属问题

On the Ownership of Real Estate Acquired by Husband and Wife after Marriage

摘要: 在市场经济高度发展的今天，婚姻财产是衡量夫妻地位平等与否的重要标志。在婚姻关系中，夫妻地位是否平等决定着夫妻间的财产关系的形态，反之，婚姻财产也就成为衡量夫妻地位平等与否的重要标志。本文通过对夫妻婚后取得的房产情况类型分析，对双方的权属问题进行探讨，合理妥善处置双方财产，有利于避免激化矛盾，维护社会稳定。

Abstract: Nowadays, with the high development of market economy, marital property is an important symbol to measure whether the status of husband and wife is equal or not. In the marriage relationship, whether the status of husband and wife is equal determines the form of the property relationship between husband and wife; on the contrary, the marital property has become an important symbol to measure the status of equality of husband and wife. Based on the analysis of the type of real estate acquired by the couple after marriage, this paper discusses the ownership of both parties, and reasonably and properly handles the property of both parties, which is conducive to avoiding intensified conflicts and maintaining social stability.
