对正当防卫时间条件的修正——以受虐妇女杀夫案为视角

Amendment to the Time Conditions of Justifiable Defense—From the Perspective of the Murder of Battered Women

摘要: 针对受虐妇女杀夫案的定性，学者们主要提出防御性紧急避险、受虐妇女综合征、期待不可能以及正当防卫，以正当防卫作为出罪事由较为合适，但需对正当防卫时间条件加以修正。现存诸多关于不法侵害“正在进行”开始时间和结束时间的认定观点，并不能对该类案件的防卫时间准确判断。对此，采用整体性评价方式、立足于防卫人角度两个方面对案件防卫时间进行判断，从而使得该类案件适用正当防卫，实现正义。

Abstract: In view of the characterization of the murder of battered women, scholars mainly put forward defensive emergency avoidance, battered women’s syndrome, expectation impossibility and self-defense. It is more appropriate to take self-defense as the cause of crime, but the time conditions of self-defense need to be modified. Many existing opinions on the start time and end time of “ongoing” illegal infringement can not accurately judge the defense time of such cases. In this regard, we use the holistic evaluation method and judge the defense time of the case from the perspective of the defender, so as to make this kind of case applicable to justifiable defense and realize justice.
