论网络著作权侵权行为的法律规制

On the Legal Regulation of Network Copyright Infringement

摘要: 三尺万卷书，治国安天下。书是作者珍贵的智慧结晶，随着科技时代的到来，网络作品也应运而生，无独有偶，随即而来的是网络著作权盗版行为的横生枝节，侵权行为肆虐。尤其是当下，网络著作权法律制度不完善，更易引起纠纷。据此，完善网络著作权法律制度乃是燃眉之急。本文首先详细描述了网络著作权的概念、特征。并结合当前时代背景，展现出了目前保护网络著作权的紧迫性和必要性。随后挖掘了网络著作权侵权方面的认定问题和一些具体表现形式，介绍了这种侵权模式的特征以及涉及到新角度、新思路。在此基础上，对当下网络著作权保护方面出现的不足进行了分析，最终结合当前互联网高速发展现状提出完善建议，以期促进对网络著作权侵权行为的法律规制。

Abstract: Three feet ten thousand volumes, rule the country and the world. The book incarnates the author’s precious wisdom. With the advent of the technology era, the network works emerged, then comes the network of copyright piracy, rampant infringement. In particular, the network copyright legal system is not perfect, more easily causes the dispute. It is urgent to perfect the legal system of network copyright. Firstly, this paper describes the concept and characteristics of network copyright in detail. Combined with the current background of the times, it shows the urgency and necessity of protecting the network copyright at present. This paper dug up the problem of the cognizance and some concrete forms of the infringement of the network copyright. At the same time, this paper introduces the characteristics of this tort model and involves a new perspective, new ideas. On this basis, the author analyzes the shortcomings of the current protection of Internet copyright. Finally, it puts forward some suggestions to improve the current high-speed development of the Internet, with a view to promoting the legal regulation of Internet copyright infringement.
