What Is the Accuracy of Legal Language?

摘要: 法律语言的精确性被普遍认为是法律语言最重要的特征之一，我们却很少对这一特征进行理论思辨。本文在解构静态法律语言精确性的基础上，依据皮尔斯三位一体符号模型，从法律语义生成的角度建构法律语言精确性的动态实践观，指出了解法律语义的生成过程是认识法律语言精确性的前提和基础。法律语言的精确性是具有典型性的法律语用事件，是法律主体在构建法律规范文本与法律事实之间关联的过程中，所呈现出的相似性的认知效果和共识。

Abstract: The accuracy of legal language is generally considered to be one of the most important features of legal language, but we seldom make theoretical speculation on this feature. On the basis of deconstructing the static accuracy of legal language, this paper constructs a dynamic practice view of accuracy of legal language from the perspective of the generation of legal semantics according to Pearce’s trinity symbol model, and points out that understanding the generation process of legal semantics is the premise and foundation of understanding the accuracy of law language. The accuracy of legal language is a typical legal pragmatic event, which is the cognitive effect and consensus of similarity presented by legal subjects in the process of constructing the relationship between legal norms and legal facts.
