大数据“杀熟”行为中侵犯消费者权益的研究——基于市场和技术的双重视角
Research on Infringement of Consumers’ Rights and Interests in Big Data “Killing” Be-havior—Based on the Dual Perspectives of Market and Technology
摘要: 近年来,大数据技术带来的正面与负面效应不相上下。“3.15晚会”曝光电商平台滥用大数据窃取用户个人信息、平台经营者利用用户信息和算法技术对消费者实施差别定价等现象,使得公众对极具隐蔽性的大数据“杀熟”行为更加关注。本文通过探究大数据“杀熟”的本质及对消费者权益的侵害路径,从监管机构、平台和用户等方面提出对策建议,以期充分保障大数据算法背景下消费者享有的各项权利。
Abstract:
In recent years, big data technology has brought about both positive and negative effects. The “3.15 Party” exposed that e-commerce platforms abused big data to steal users’ personal information, and platform operators used user information and algorithm technology to implement differential pricing on consumers, which made the public pay more attention to the highly hidden “killing” of big data. By exploring the essence of big data “killing” and the path of infringement on consumers’ rights and interests, this paper puts forward countermeasures and suggestions from the aspects of regulators, platforms and users, with a view to fully protecting consumers’ rights under the back-ground of big data algorithms.
