摘要: 在创造性判断中，需要考量“预料不到的技术效果”，前提条件是带来该预料不到技术效果的特征选择不是一种必然的趋势，而是非必然的选择。本文结合实际案例剖析哪些技术效果是可合理预期的，以及“预料不到的技术效果”与“单行道”情景中奖励式效果之间的关系。
Abstract: “Unexpected technical effect” is a necessary consideration factor in inventive step of patent. The premise is that the feature selection that leads to the unexpected technological effect is not a trend, but a non-inevitable choice. This article analyzes which technical effects can be reasonably expected based on actual cases, and the relationship between “unexpected technical effect” and bonus effect in the “one way street” scenario.
