摘要: 在邮轮上发生的旅客人身损害问题逐渐进入大众视野，由于我国对这一类问题的法律适用尚无具体的规定，司法实践也没有统一且严格的界定，导致各方权利义务不清晰，旅客维权困难。旅游服务合同可能兼具多种合同性质，本质上是一种混合合同。在邮轮旅游法律关系中可能会涉及到海上消费者服务合同，旅客运输合同，侵权行为的法律适用问题，以及承运人责任限制条款和格式条款的相关法律问题，本文将结合人身损害发生的原因以及当事人的选择，讨论不同情况下的法律适用规则。

Abstract: The problem of personal injury of passengers on cruise ships has gradually entered the public’s view. Because there are no specific provisions on the legal application of this kind of problems in China, and there is no unified and strict definition in judicial practice, the rights and obligations of all parties are not clear, and it is difficult for passengers to safeguard their rights. Tourism service contract may have a variety of contract nature, which is essentially a mixed contract. The legal relationship of cruise tourism may involve the legal application of maritime consumer service contracts, passenger transport contracts, torts, as well as the legal issues related to the carrier’s liability limitation clauses and standard clauses. This paper will discuss the applicable rules of law under different circumstances in combination with the causes of personal injury and the choice of the parties.
