我国知识产权侵权惩罚性赔偿制度研究

Research on Punitive Compensation System of Intellectual Property Rights Infringement

摘要: 目前，我国在知识产权领域已基本建立起了惩罚性赔偿制度，但是不可否认该制度仍然存在一系列的问题与不足之处，为充分利用惩罚性赔偿制度在知识产权领域的功能，这需要在司法实践中进一步明确其具体适用条件。因此，在对我国近几年的知识产权惩罚性赔偿的司法现状进行实证分析的基础之上，正确认识目前知识产权侵权惩罚性赔偿制度的司法实践困境，界定知识产权惩罚性赔偿制度的主观要件和客观要件，同时梳理法定赔偿与惩罚性赔偿之间的关系，由此对我国知识产权惩罚性赔偿制度的法律适用提出相应的建议。

Abstract: At present, our country has basically established punitive compensation system in the field of intellectual property, but there are still a series of problems and shortcomings in this system. In order to make full use of the functions of punitive compensation system in the field of intellectual property, this needs to further clear its specific ap-plication conditions in judicial practice. Therefore, based on the empirical analysis of the punitive compensation of intellectual property rights in recent years, it is positive to recognize the judicial practice dilemma of the punitive compensation system for intellectual property infringement, and to define the subjective elements and objective elements, while sorting out the relationship be-tween legal compensation and punitive compensation. This paper proposes corresponding sugges-tions for the legal application of punitive compensation system of intellectual property rights.
