我国合规不起诉制度的发展路径与落地方案研究——以改革试点案例为切入点

Research on the Development Path and Implementation Scheme of China’s Compliance-Based Non-Prosecution System—Taking Reform Experimentation Cases as the Breakthrough Point

摘要: 企业合规不起诉制度在保障企业发展、稳定市场经济秩序、促进国家经济方面具有重要意义。随着相关规范性文件的陆续出台，各地检察机关探索合规制度的工作初见成效。本文以部分改革试点案例为切入点，对检察机关的相应处理方式进行整合判断，对合规不起诉制度目前已显现的问题进行分析，试图探索合规不起诉制度在我国的发展路径与完善建议。

Abstract: The enterprise’s compliance-based non-prosecution system is of great significance in ensuring the development of enterprises, stabilizing the order of the market economy and promoting the national economy. With the introduction of relevant normative documents, procuratorial organs around the country have achieved initial success in exploring compliance systems. This article takes some reform experimentation cases as the breakthrough point, makes an integrated judgment on the corresponding handling methods of the procuratorial organs, analyzes the problems that have emerged in the compliance-based non-prosecution system, and attempts to explore the development path and improvement suggestions of the compliance-based non-prosecution system in China.
