论民事诉讼中电子数据证据的真实性——基于新《民事证据规定》的分析

摘要: 电子数据证据近年来在民事诉讼中大量出现，电子数据证据的真实性是使其被法庭采纳的第一道门槛，但实务中存在使用电子数据证据的复制件来审查其真实性的问题，同时也存在认为电子数据证据本身真实性不足的偏见，造成很多电子数据证据由于偏见被法庭拒之门外，使电子数据证据独有的价值却没有得到充分发挥。相比于传统证据，电子数据证据的独有特征使其更符合如今互联网法院时代的要求。“电子数据证据真实性专条”的出台是电子数据证据立法中的新突破，但仍有适用不充分的问题，司法工作人员及民事诉讼当事人应当站在更为理性的视角看待电子数据证据。

Abstract: In recent years, electronic evidence has emerged in a large number of civil lawsuits in China. The authenticity of electronic evidence is the first threshold to be accepted by the court. However, in practice, there are problems of using copies of electronic evidence to examine its authenticity, and there are also prejudices that the authenticity of electronic evidence itself is not enough. As a result, much electronic evidence is rejected by the court due to prejudice, so that the unique value of elec-tronic evidence has not been fully played. Compared with traditional evidence, the unique charac-teristics of electronic evidence make it more in line with the requirements of the Internet court era. The promulgation of “special article on authenticity of electronic evidence” is a new breakthrough in the legislation of electronic evidence, but there are still problems of inadequate application. Judges and Parties to civil suits should stand in a more rational perspective to treat electronic evidence.
